1 Parties
Platform Owner (Company):
User:
The person who uploads content (photos, videos, audio content, etc.) to the platform.
Invitation Owner:
The person or institution for whom the uploaded content is intended; usually organizers or event owners.
2 Subject and Scope of the Agreement
This agreement regulates the rules that the User must follow while uploading content via qr.hatiradeposu.com and other Hatıra Deposu platforms and the framework of responsibility for the uploaded content. At the same time, it covers the obligations of the Invitation Owner regarding the use of the content.
3 Obligations of the User
3.1 Content Responsibility
The User assumes all legal responsibility for the content they upload. It is essential that the content does not violate the law, public order, morality, and personal rights. The User declares that they own the copyright of the content or have permission to use it.
3.2 Obtaining Consent
The User is obliged to obtain the explicit consent of the persons featured in the content. All legal responsibility arising from content uploaded without consent belongs to the User.
3.3 Permission for Use and Sharing
The User explicitly agrees that the content they upload may be shared, viewed, and stored in a digital environment by the Invitation Owner and authorized persons.
3.4 Legal Compliance
The User guarantees that the content they upload complies with copyright, KVKK, privacy, and all relevant laws. Any claims and damages directed to the Company and the Invitation Owner will be covered by the User.
3.5 Harmful Content and System Security
The User undertakes not to upload any elements that may create malware, viruses, or security breaches to the Platform. Obscene, threatening, insulting, or discriminatory content is strictly prohibited.
4 Obligations of Invitation Owners
4.1 Use for Personal Purposes
Invitation Owners may store and share content only for personal use related to the invitation. Commercial use, unauthorized sharing, and distribution are prohibited.
4.2 Legal Responsibility
Invitation Owners are obliged to show necessary care regarding the use of uploaded content. The Invitation Owner may also be held responsible for legal consequences arising from inappropriate use.
5 Rights and Obligations of the Company
5.1 Content Moderation
Hatıra Deposu may moderate the content uploaded to the Platform. It may delete non-compliant content without notice and cooperate with relevant authorities.
5.2 Content Removal
Content may be deleted in cases of copyright infringement, violation of personal rights, or breach of contract. In such cases, the User cannot claim any rights or compensation.
5.3 Legal Action
The Company reserves the right to initiate legal action against the User for behaviors contrary to the agreement.
5.4 Data Security
The Company takes necessary technical and administrative measures for the security of the content. However, it is not responsible for violations that occur after the content is shared with Invitation Owners or other authorized users.
6 Termination and Cancellation of the Agreement
When the User acts contrary to this agreement, Hatıra Deposu may temporarily or permanently block the User's access. Additionally, all content uploaded by them may be deleted from the system.
7 Resolution of Disputes
Kocaeli Courts and Enforcement Offices are authorized for any disputes that may arise from this agreement.
8 Effectiveness
This agreement enters into force when the User uploads content to the Platform.
