This Distance Sales Agreement has been established between Hatıra Deposu ("SELLER") and the customer ("BUYER") within the scope of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.
1 Parties
SELLER:
BUYER:
The real or legal person who purchases services through the Hatıra Deposu platform.
2 Subject of the Agreement
The subject of this agreement is the regulation of the rights and obligations of the parties in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale and delivery of the digital services ordered by the BUYER via the SELLER's website www.hatiradeposu.com, the characteristics and sales price of which are specified below.
Services Sold:
- Digital album creation service
- Memory collection system via QR code
- Photo and video storage service
- Voice memory recording feature
- Memory note adding feature
- Physical products (QR coded cards, welcome boards, etc.)
3 General Provisions
a) The BUYER accepts that they have read and are informed about the product/service features, sales price, payment method, and delivery information on the product/service promotion page on the site.
b) The BUYER is deemed to have accepted all features of the product/service they ordered.
c) The SELLER is obliged to deliver the product/service ordered by the BUYER to the BUYER within the period specified in the agreement.
d) The BUYER has the right to withdraw from the agreement within 14 (fourteen) days from the delivery of the product/service they ordered, without giving any reason and without paying any penalty.
4 Right of Withdrawal
The BUYER cannot use the right of withdrawal in the following cases:
- If digital contents have started to be used by the consumer
- If physical products are opened, used, or damaged
- If personalized services are completed
- If the service cannot be completed due to force majeure
Withdrawal period: 14 (fourteen) days
Start of withdrawal right: The date the service is delivered
5 Payment and Delivery Conditions
Payment Conditions:
- Payment is made by credit card or debit card at the time of order
- Payment transactions are carried out through a secure payment infrastructure
- Shipping fee for physical products is specified separately
- No additional fee is charged for digital services
Delivery Conditions:
- Digital services are activated immediately after the order
- Physical products are delivered by cargo within 3-5 business days
- Delivery time may vary depending on stock status
- Cargo tracking information is notified to the BUYER via e-mail
6 Dispute Resolution
In disputes arising from this agreement:
- Primarily, consumer arbitration committees are applied to
- In cases where consumer arbitration committees are not authorized, consumer courts are authorized
- The subject of the dispute is evaluated within the scope of the Law No. 6502 on the Protection of Consumers
7 Effectiveness
This Distance Sales Agreement, consisting of 7 articles, enters into force upon electronic approval by the BUYER. The agreement is deemed to have been accepted by the parties.
