Platform Owner:
Invitation Owner:
The person or institution that creates a digital album from media content through the Platform and publishes this album ("Invitation Owner" or "you").
Persons in Media Content:
Individuals in photos, videos, audio content, and other media types taken at invitations and uploaded to the Platform.
2 Subject and Scope of the Agreement
This agreement determines the principles regarding the publication of digital albums created by the Invitation Owner through the Platform, the rights of the persons in the media content in these albums, and the obligations of the Invitation Owner. This agreement becomes effective with the creation of the digital album and its public sharing.
3 Creating and Publishing Digital Albums
3.1 Creating an Album
The Invitation Owner can create a digital album from the uploaded media content and publish this album publicly.
3.2 Publishing Responsibility
The consent of the persons in the album must be obtained in writing or orally; the obligation to prove the existence of these consents belongs to the Invitation Owner. The Invitation Owner is responsible for the legality of the content.
3.3 Media Retention Period
The album remains accessible on the Platform unless deleted by the Invitation Owner. It is not automatically deleted by the system.
3.4 Rights of Relevant Persons
Individuals in the media content have the right to request the removal of the content. These requests are directed to the Invitation Owner, and it is the Invitation Owner's obligation to do what is necessary.
3.5 Viewing Conditions
Digital albums can be viewed by anyone with the link. The Invitation Owner is responsible for any legal and social consequences that may arise.
4 Obligations of the Invitation Owner
4.1 Responsibilities
The Invitation Owner is personally responsible for any damage, right violation, or complaint that may arise from the media content.
4.2 Removal Requests
It is the Invitation Owner's obligation to ensure the removal of content by meeting the requests of the relevant persons.
4.3 Protection of Brand Reputation
Shared content must be used in a way that does not harm the Hatıra Deposu brand. Contrary content may be deleted by the company.
5 Responsibilities of the Platform Owner
5.1 Information
Content removal requests from relevant persons are forwarded to the Invitation Owner. Hatıra Deposu is not responsible for the fulfillment of these requests.
5.2 Legal Responsibility
Hatıra Deposu does not have any legal, criminal, or financial responsibility that may arise from the contents of the digital albums created on the Platform.
6 Resolution of Disputes
Disputes that may arise from this agreement will be resolved by Kocaeli Courts and Enforcement Offices.
7 Effectiveness
This agreement becomes effective when the Invitation Owner creates and publishes a digital album.
